Protech Diamond Tools, Inc. v. Protech Diamond Tools, Inc. et al.
Represented defendants and counterclaimants Protech Diamond Tools, a Canadian company, and its corporate officer, in Federal and State trademark infringement lawsuit. The Quintana Law Group successfully defeated plaintiff's motion for preliminary injunction to enjoin its client's use of the "Protech Diamond" mark as well as defeated plaintiff's motion to dismiss its clients' counterclaims.
Harry Michael Fox Architect v. Madison Hilderbrand, et al.
Represented plaintiff architect in lawsuit alleging violations of the Copyright Act and Digital Millennium Copyright Act against real estate brokerage firm and agents. The Quintana Law Group successfully defeated defendants' motion to dismiss claims.
eFund Capital Partners v. Pless, et al.
Represented AIM Group, LLC, Powweb, Inc. and corporate defendants in a complex shareholder derivative suit concerning mortgage presentation software program. After the trial court’s refusal to compel arbitration of extracontractual disputes involving the firm’s clients, the Quintana Law Group obtained a reversal by the California Court of Appeal. The appellate court’s decision constituted an unprecedented expansion of the scope of arbitration provisions in business contracts and allowed QLG’s clients to arbitrate their claims. The appellate court’s decision was published in 150 Cal. App. 4th 1311 (2007).

DSPT International, Inc. v. Jaysix USA, Inc. et al.
Represented clothing designer and wholesaler Jaysix USA, Inc. in trademark infringement and unfair business practices lawsuit. Seeking close to half a million dollar in damages, Plaintiff claimed Jaysix, among other things, infringed on several trademarks associated with Plaintiff’s clothing labels. Short-circuiting a costly and protracted trial, QLG filed and won a motion for summary judgment on Jaysix’s behalf. QLG further succeeded in obtaining an award against Plaintiff for Jaysix’s attorneys’ fees and costs.

Lombard Enterprises, Inc. v. Brenbecke, LLC
Represented Brenbecke and corporate officers in alleged trade secrets misappropriation lawsuit wherein Plaintiff sought over $1 million dollars in damages. The Quintana Law Group aggressively defended the lawsuit causing Plaintiff to unilaterally dismiss the entire case with no monies paid by QLG clients.
William Krisel v. Pro-Active Business Services, Inc.
Represented Pro-Active Business Services, Inc. and corporate officer and employees in alleged architectural copyright and trademark infringement lawsuit. The Quintana Law Group successful obtained dismissal from the federal court of all trademark claims and significantly narrowed Plaintiff’s copyright claims, by arguing that the majority of the copyright elements claimed by the Plaintiff through purported architectural works and technical drawings were in the public domain. Plaintiff dismissed the case which no monies paid by QLG clients.

Hojiwala v. Virtu-All Technologies, Inc. et al.. (Complex Class Action)
Represented Virtu-All Technologies, Inc. in class action lawsuit alleging violation of California’s Consumer Legal Remedies Act, unfair competition and false advertising and wherein Plaintiff sought injunctive relief and compensatory and punitive damages. The Quintana Law Group aggressively defended the lawsuit causing Plaintiff to dismiss QLG’s client from the case with no monies paid by QLG’s client.
Q-Electric, LLC v. Brisaki, LLC, et al.
Represented dune buggy seller Brisaki, LLC in alleged federal trademark infringement lawsuit wherein Plaintiff, a dune buggy manufacturer and distributor, sought over $1 million dollars in damages. The Quintana Law Group aggressively defended the lawsuit causing Plaintiff and its counsel to be monetarily sanctioned by the federal court and Plaintiff to unilaterally dismiss the entire case with no monies paid by QLG clients.
